Session Fee includes services of the photographer with the equipment, lighting, props, and engaging the photographs. Photographer shoots until the contracted coverage time is met. Additional time is billed in 15 minute increments at $150/hr. Session Fee also includes the post-production editing of all the best images selected by DestinPhoto.com (Approximately 10-15% of total shutter clicks during contracted session) and provided on a Studio Proofing Gallery with watermark. Client may share studio proofing gallery electronically on any media platform they wish. Client may not download, screenshot, or print images from The Studio Proofing Gallery without a copyright release provided by DestinPhoto.com.
*Session fee does NOT include any high-resolution images and/or copyright release. Edited High-Resolution files with copyright release are sold separately. Starting at $225.00 for the first initial household and $75/per each additional household in each session.
It is understood and agreed that no other cameras, cellphones, tablets, or devices capable of capturing still images or video will be allowed during posed or arranged shots while the Photographer is working.
If passes or codes are required for either location, please ensure the photographer is aware and/or is able to make arrangements prior to arrival. DestinPhoto.com will not be held responsible for tardiness or lack of arrival due to security guards or inaccurate security codes
Each Portrait Session is an agreement that constitutes an order for portraiture services, including the taking of pictures as agreed to by both parties: DestinPhoto.com and Contracting Party (Client). Unless otherwise specified, it is understood that any and all rights to proofs, final or sample prints, thereof shall remain the property of DestinPhoto.com and may be used for advertising, display or any other purpose thought proper by DestinPhoto.com.
In the event of inclement weather for outdoor photo sessions, DestinPhoto.com reserves the right to engage in scheduled sessions even if it's raining. DestinPhoto.com monitors the weather radar constantly when outdoor photo sessions are scheduled and will make the best judgement call on account of lightning strikes within a 5-mile radius as the needed. Your patience and cooperation with our experience regarding the weather on The Emerald Coast is greatly appreciated. (We want your pictures to be beautiful too!)
In the event that a scheduled outdoor photo session needs to be modified due to weather or other acts of god, Client agrees to cooperate with DestinPhoto.com as every effort is made to ensure your outdoor photo session is accomplished while you are still in the area of your photographer/destinphoot.com studio. Whether the scheduled time or date needs to be adjusted to ensure the best conditions are met for your session. When "Wash-Outs" occur during peak season (Between Memorial Day and Labor Day.) some sessions may be double booked with each other to make sure everyone's portraits are accomplished.
If Photographer cannot perform an agreement in whole or in part due to a fire or other casualty, acts of God or nature or terror, or other cause beyond the control of the parties or due to Photographer's illness or injury, then DestinPhoto.com will return all fees to the Client(s) but shall have no further liability with respect to the Agreement. The limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, or otherwise lost or damaged without fault on the part of the Photographer and/or the destinphoto.com team.. Client(s) agree that DestinPhoto.com’s liability is limited to the amount paid under session invoice at the time of booking.
Refunds and studio credit may only be issued if DestinPhoto.com is unable to complete your photo session before you leave The Emerald Coast or if a documentable medical emergency arises. It is agreed that DestinPhoto.com does not accept cancelations due to the demand of services during peak season (memorial day thru labor day). Any cancelation requests must be provided to destinphoto.com IN WRITING NO LATER THAN FIVE BUSINESS DAYS PRIOR TO SCHEDULED SESSION/PHOTOGRAPHY SERVICES. If studio is unable to rebook session provided with less than five business days notice, then the invoice amount paid will be issued as studio credit to be used at a future date. If studio is able to rebook - then DestinPhoto.com will issue a complete refund as per the studio refund/credit guidelines provided under the Terms & Conditions of www.DestinPhoto.com.
The photographer is limited by the guidelines of location officials or site management. For In-Door Events/Locations - client agrees to accept the technical results of their imposition on the photographer. Negotiation with any officials for modification of guidelines is client's responsibility; DestinPhoto.com will offer technical recommendations only.
COPYRIGHT: All photographs produced by DestinPhoto.com are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without Jennifer Miller’s explicitly written permission. Upon purchase of Copyright Release client gains limited copyright ownership of the resulting images allowed to the CLIENT under the following conditions:
●The prints are the property of CLIENT for personal use and for the purposes of display and giving photographs to friends and relatives.
●Images may be used on personal web sites and social media profiles as long as a copyright notice appears near the images stating that they were taken DestinPhoto.com as well as a web link to http://www.DestinPhoto.com is placed onto the web site.
●The Client must obtain written permission from and compensate DestinPhoto.com prior to the CLIENT or its friends and relatives publishing or selling the photographs for profit.
MODEL RELEASE: The CLIENT hereby grants to DestinPhoto.com and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of client, in which the client may be included, and/or images captured during the photographic session including but not limited to private residences and public venues. DestinPhoto.com reserves the right to print, publish, images obtained for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The client hereby releases DestinPhoto.com and its legal representatives and assigns from all claims and liability relating to said photographs. DestinPhoto.com will not notify clients before images are used.
20% Off All Heirloom Prints, Products, & Copyright Releases must be paid PRIOR to Clients Studio Proofing Gallery going live. (approximately one month after the completed photo session.) Discounted offer on all preorders must be paid in full or payment arrangements locked in writing before the client's studio proofing gallery goes live on smugmug.com. payment plans are available and may be arranged through Destin Photo at the time of booking or order inquiry. Promotional discount may not be applied to other sessions or stacked with a separate discount/promotional offer.
Graduation session fee includes, (8) eight 3.5"x5" Archival Prints displayed in a beautiful gate-folding, leather, senior tri-folio display and one pack (25) twenty-five accordion or gate folded announcement cards with envelopes.
Graduation session includes up-to (5) five changes of clothing/hair/make-up (Hair/Makeup Artist not included), photography services/posing of (1) one person. No additional portraits of family, friends, engagements, etc is allowed during Graduation Portrait Session. No third-party cameras/video (phone, iPad, slr, or point & shoot) allowed during any sessions while Destin Photo and/or its agent(s) are conducting contracted services. Destin Photo reserves all rights to intelectual property of poses, tricks of the trade, layouts, products/pricing, and/or editing/post-production; all of which has developed an easily recognizable style that sets Destin Photo apart from other studio(s) and/or photographers.
